Welcome to The Shop
Pull up a chair. These Shop Terms are the Terms & Conditions for The Shop at Tracy's Pink Porch and govern your use of shop.tracyspinkporch.com, including browsing, creating an account, placing an order and purchasing products from The Shop.
By using The Shop or placing an order, you agree to these Shop Terms. If you do not agree with them, please discontinue use of The Shop.
Your use of The Shop is also subject to our Shop Privacy page, which explains how personal information may be collected, used and protected.
The main Tracy's Pink Porch website at tracyspinkporch.com, including the Porch at tracyspinkporch.com/porch/, has its own Porch Terms governing use of the main website and community.
Shopping on the Porch
The Shop offers products owned or offered for sale by Tracy's Pink Porch. Available merchandise may include closeout inventory, limited-quantity merchandise, current finds and other products offered from time to time.
Products, collections, availability and quantities may change without notice. Some merchandise may be available only in limited quantities and may not return once sold.
We reserve the right, as permitted by law, to limit quantities, discontinue products or limit sales when reasonably necessary.
Product Descriptions, Photos & Colors
We make reasonable efforts to describe and display products accurately. However, photographs, screen settings, lighting, packaging changes and other factors may cause colors, appearance or other details to vary from what you see on your device.
Product descriptions, photographs, dimensions, ingredients, materials or other information may sometimes be supplied by a manufacturer or other third party. While we try to keep Shop information accurate, we cannot guarantee that every description, photograph or other detail will always be complete, current or error-free.
If we discover a material error affecting an order, we will take reasonable steps to correct it and, when appropriate, contact you about the order.
Prices, Promotions & Availability
Prices are displayed in U.S. dollars unless otherwise stated and may change without notice. A price change will not ordinarily affect an order already accepted, except when correction is necessary because of an obvious pricing or listing error and applicable law permits the correction.
Sales, discounts, coupons, specials and other promotions may have their own eligibility requirements, dates, quantity limits, exclusions or other conditions. Those conditions will apply in addition to these Shop Terms.
Placing an item in your cart does not guarantee availability. Inventory may change before checkout is completed.
Placing an Order
When you submit an order, you are offering to purchase the selected products using the information and payment method you provide.
An order confirmation acknowledges that The Shop received your order. It does not prevent us from contacting you if there is a problem with inventory, pricing, payment, shipping information or another part of the transaction.
We may refuse, limit or cancel an order when reasonably necessary, including because of unavailable inventory, an obvious pricing or listing error, suspected fraud or misuse, payment problems, inaccurate information or circumstances that prevent us from reasonably completing the order.
If payment has already been received for an order we cannot fulfill, the applicable amount will be refunded using an appropriate method.
Your Account & Information
You may be able to shop as a guest or create a customer account, depending on the features available in The Shop.
If you create an account, you are responsible for providing accurate information, keeping your login credentials reasonably secure and updating account information when necessary.
Please provide accurate billing, shipping, contact and order information so we can process your purchase and contact you if a problem arises.
You are responsible for activity conducted through your account unless applicable law provides otherwise. Please contact Tracy's Pink Porch if you believe your account has been accessed without permission.
Paying for Your Porch Finds
The Shop may offer several payment methods. Available methods may change from time to time and will be shown during checkout when applicable.
PayPal and supported payment options: The Shop uses a PayPal checkout integration that may make PayPal, card, digital-wallet or other supported payment options available. Payment credentials are processed through the applicable payment provider rather than intentionally stored as full payment-card numbers in The Shop's ordinary customer or order records.
Venmo and Cash App: The Shop may provide manual payment instructions for Venmo or Cash App. When one of these methods is selected, payment is completed outside of OpenCart according to the instructions provided with the order.
Check, money order or other manual payment methods: When offered, these orders are handled according to the payment instructions provided at checkout or with the order.
Orders requiring manual payment may remain pending until payment is received or otherwise confirmed. We may cancel an unpaid order after a reasonable period or after any payment deadline communicated with the order.
Third-party payment services have their own terms and privacy practices. Your use of those services is also subject to the applicable provider's terms.
Shipping & Delivery
Shipping and delivery information provided by The Shop, including available methods, charges and any estimates, is subject to the applicable Shipping & Delivery information provided in The Shop.
Please make sure your shipping address is accurate before submitting an order. Contact us promptly if you discover an error.
Delivery dates or transit times provided by carriers or other delivery services may be estimates. Delays caused by carriers, weather, service interruptions, incorrect addresses or circumstances outside the reasonable control of Tracy's Pink Porch may occur.
Returns & Refunds
Returns, refunds and related requests are governed by the Return Policy available in The Shop. Please review that policy before requesting a return.
Eligibility may depend on factors such as the product, its condition, the reason for the return and the time elapsed since purchase.
Nothing in these Shop Terms or the Return Policy limits rights or remedies that cannot legally be waived under applicable law.
Porch Perks & Reward Points
The Shop may offer customer rewards, reward points or other loyalty benefits from time to time. Eligibility, earning opportunities, redemption values and availability may vary and may be changed, limited or discontinued as permitted by law.
Reward points have no cash value, cannot be exchanged for cash and may be used only as permitted through The Shop. Unless otherwise stated, rewards may not be transferred between customer accounts.
The Shop may also offer promotional loyalty programs, punch cards, coupons or other customer rewards. Individual offers may have their own eligibility requirements, expiration dates, redemption rules or other conditions, which will be provided with the applicable offer.
Rewards or points associated with canceled, refunded or returned purchases may be adjusted or removed. Tracy's Pink Porch may also correct reward balances resulting from technical errors, misuse or other improper activity.
Staying Connected
Creating an account or placing an order does not automatically enroll you in marketing emails.
If you voluntarily choose to receive the Tracy's Pink Porch newsletter or other optional marketing communications, you may change that preference through your account when the option is available or ask us to stop sending marketing email.
Transactional messages needed to manage an account, process an order, provide customer service, handle a return or refund, or respond to something you requested are separate from optional marketing communications.
Texting the Porch
Tracy's Pink Porch publishes the business telephone number 234-200-6556 so customers and visitors may voluntarily call or initiate a text conversation.
Tracy's Pink Porch does not currently operate a recurring SMS marketing or promotional text-message program.
If you send a text message to Tracy's Pink Porch, you are initiating the conversation and agree that Tracy's Pink Porch may send replies reasonably related to your inquiry, order, customer-service matter or other conversation you initiated.
Initiating a text conversation or providing a mobile number for an account or order does not enroll you in recurring marketing messages, and consent to receive text messages is not a condition of purchase.
Message and data rates may apply. If Tracy's Pink Porch offers a recurring SMS marketing program in the future, separate enrollment, consent and program-specific terms will be provided before recurring promotional messages are sent.
When You Step Beyond The Shop
The Shop may contain links to third-party websites, payment providers, social media platforms, manufacturers, services and other online destinations.
Once you follow a link to another website or service, that destination's own terms, privacy practices and policies apply. Tracy's Pink Porch does not control and is not responsible for the availability, content, security, products, services, policies or practices of third-party websites or services.
Reviews, Comments & Things You Share
If The Shop allows reviews, comments or other customer submissions, you are responsible for the material you choose to submit.
Please do not submit unlawful, threatening, harassing, hateful, defamatory, deceptive, infringing, invasive, spam-like or otherwise inappropriate material, or personal or confidential information you do not have the right to share.
You retain ownership of original content you submit. By voluntarily submitting content for public display in The Shop, you give Tracy's Pink Porch permission to display that content as reasonably necessary to operate the feature in which you submitted it.
We may moderate, edit, hide or remove customer-submitted content when reasonably necessary to protect The Shop, customers or others, comply with law or maintain an appropriate shopping environment.
Our Porch, Our Content
Unless otherwise indicated, original Shop text, graphics, branding, photographs and other original content created for Tracy's Pink Porch are owned by Tracy's Pink Porch or the applicable creator and are protected by applicable intellectual-property laws.
Please do not copy, republish, reproduce, sell, present as your own or commercially use original Tracy's Pink Porch content without permission, except where applicable law allows otherwise.
Third-party names, trademarks, logos, product images and other intellectual property remain the property of their respective owners.
Please Shop Fairly
You may not use The Shop for unlawful, fraudulent, abusive or deceptive purposes; interfere with its operation, security or availability; attempt unauthorized access to the website or related systems; distribute malicious code or spam; misuse promotions, rewards or customer accounts; violate the rights of others; or otherwise violate applicable law.
We may restrict access, cancel affected transactions or take other reasonable action when necessary to protect The Shop, customers, Tracy's Pink Porch or others from fraud, misuse or security threats.
No Promises About Perfect Wi-Fi
The Shop and its website features are provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee that the website will always be available, uninterrupted, error-free or free from technical issues.
To the extent permitted by applicable law, Tracy's Pink Porch disclaims warranties that may otherwise arise from use of The Shop or website, except for warranties that cannot legally be excluded.
This website disclaimer does not eliminate warranties, consumer protections or other rights that apply to a product or transaction and cannot legally be waived.
Limits of Responsibility
To the extent permitted by applicable law, Tracy's Pink Porch will not be liable for indirect, incidental, special, exemplary or consequential losses arising from use of, or inability to use, The Shop or third-party websites or services linked from it.
Nothing in these Shop Terms excludes or limits liability, warranties, consumer rights or remedies where doing so would not be permitted by applicable law.
If One Porch Board Comes Loose
If any provision of these Shop Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

These Shop Terms, together with the Shop Privacy page and any policies, offer terms or notices expressly referenced here, describe the agreement governing use of The Shop and purchases made through it.
Specific policies or promotional terms may provide additional rules for a particular transaction, service or offer. If a specific term directly conflicts with these general Shop Terms, the more specific term will control for that particular matter to the extent permitted by law.
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
Ohio Is Home Base
These Shop Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Changes Around The Shop
Tracy's Pink Porch may update these Shop Terms from time to time to reflect changes to The Shop, products, payment methods, loyalty programs, website features, policies, services or applicable requirements.
Updated Shop Terms will be posted on this page and the Last Updated date will be changed. Changes generally apply prospectively and do not retroactively change the agreed terms of a completed transaction except where permitted or required by law.
